Gather Offroad is a platform that connects riders with local trail guides for offroad experiences including UTV, ATV, and dirt bike tours. We facilitate bookings between riders and independent guides but are not ourselves a tour operator.

3. User Accounts

To use certain features of the Platform, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete information
Updating your information to keep it current

4. Rider Responsibilities

As a rider using the Platform, you agree to:

Provide accurate information about your experience level and equipment
Follow all safety instructions provided by your guide
Wear appropriate safety gear as required
Sign any required liability waivers before participating in tours
Comply with all local laws and trail regulations
Treat guides and other riders with respect

5. Guide Responsibilities

As a guide using the Platform, you agree to:

Provide accurate information about your qualifications and experience
Maintain any required licenses, permits, or insurance
Prioritize the safety of all riders
Honor confirmed bookings or provide adequate notice of cancellation
Respond to booking requests in a timely manner
Comply with all local laws and regulations

6. Bookings and Payments

All payments are processed through our secure payment provider. By making a booking, you agree to:

Pay all fees associated with your booking
Our cancellation and refund policies
Platform service fees that may apply

7. Cancellations and Refunds

Cancellation policies may vary by guide. Please review the specific cancellation policy before booking. In general:

Cancellations made more than 48 hours before the scheduled tour may be eligible for a full refund
Cancellations made within 48 hours may be subject to partial or no refund
Weather-related cancellations will be handled on a case-by-case basis

8. Assumption of Risk

Offroad activities involve inherent risks including but not limited to injury, property damage, and death. By using the Platform and participating in guided tours, you acknowledge and accept these risks. You agree to sign any required liability waivers before participating in tours.

9. Limitation of Liability

Gather Offroad is a platform that facilitates connections between riders and guides. We are not responsible for the actions, omissions, or conduct of any guide or rider. To the maximum extent permitted by law, Gather Offroad shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is the property of Gather Offroad or its licensors and is protected by intellectual property laws.

11. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose
Harass, abuse, or harm other users
Provide false or misleading information
Attempt to circumvent the Platform to avoid fees
Interfere with the proper functioning of the Platform

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

13. Changes to Terms
